You acknowledge and agree that you are familiar with each Event and the activities taking place in connection therewith, and you are solely responsible for determining whether your fitness or skill level is appropriate for your participation. You are aware that these activities may be dangerous and involve the risk of serious injury and/or death and/or property damage. YOU KNOWINGLY AND FREELY ASSUME ALL HAZARDS, DANGERS, AND RISKS, BOTH KNOWN AND UNKNOWN, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES (AS DEFINED BELOW) OR OTHERWISE, AND YOU ASSUME FULL RESPONSIBILITY FOR YOUR PARTICIPATION IN THE EVENTS.

You are solely responsible for any loss or theft of or damage to your personal property. Neither LinksDAO, Inc. nor any entity operating any aspect of an Event (including any facility where an Event may take place) accepts responsibility or assumes risk for lost, stolen, or damaged property.

You, on your own behalf and on behalf of your respective heirs, assigns, personal representatives and next of kin, HEREBY EXPRESSLY WAIVE AND RELEASE, COVENANT NOT TO SUE, DISCHARGE AND HEREBY AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS, LinksDAO, Inc., its affiliates and any of its and their respective officers, directors, officials, agents, employees, partners, board members, affiliates, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the Events (collectively, the “Releasees”), WITH RESPECT TO ANY AND ALL CLAIMS, CAUSES OF ACTION, DAMAGES, LOSSES AND/OR EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING OUT OF OR RELATING TO ANY INJURY, ILLNESS, DISABILITY, DEATH, OR LOSS OR DAMAGE OF ANY KIND TO PERSON OR PROPERTY, KNOWN OR UNKNOWN, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, during or related to your participation in the Events, to the fullest extent permitted by law.

Due to the uncertainty related to the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, collectively “COVID-19”), your registration, attendance and/or participation at the Events are subject to all security, safety and health requirements and policies established by LinksDAO, Inc. and/or the venues where any Event is held, including any requirements relating to facemasks and/or enhanced health screenings (which may include a requirement that you or any person who is in your party, be tested and/or provide proof of vaccination for COVID-19 prior to the Event). Any such policies and requirements as they may be updated from time to time (in the sole determination of LinksDAO, Inc. or any venue operator) are collectively referred to herein as the “Safety Requirements.” You acknowledge and agree to comply with the Safety Requirements (including all requirements that must be satisfied prior to or during the Event) and all applicable laws, policies, orders, protocols, and guidelines issued by federal, state, and local authorities respecting COVID-19 and other communicable diseases, and your attendance and/or participation at any Event is expressly conditioned on such compliance.

YOU EXPRESSLY ACKNOWLEDGE AN INHERENT RISK OF EXPOSURE TO COVID-19 EXISTS IN ANY PLACE WHERE PEOPLE ARE PRESENT AND THAT NO PRECAUTIONS (INCLUDING THE SAFETY REQUIREMENTS DESCRIBED ABOVE) CAN ELIMINATE THE RISK OF EXPOSURE TO COVID-19. COVID-19 IS AN EXTREMELY CONTAGIOUS DISEASE THAT CAN LEAD TO SEVERE ILLNESS AND DEATH. WHILE PEOPLE OF ALL AGES AND HEALTH CONDITIONS HAVE BEEN ADVERSELY AFFECTED BY COVID-19, CERTAIN CATEGORIES OF PEOPLE HAVE BEEN IDENTIFIED BY PUBLIC HEALTH AUTHORITIES AS HAVING GREATER RISK BASED ON AGE AND UNDERLYING MEDICAL CONDITIONS. YOU VOLUNTARILY ASSUME ALL RISK AND DANGER OF PERSONAL INJURY (INCLUDING DEATH), SICKNESS (INCLUDING ILLNESS AND OTHER RISKS OF EXPOSURE TO COVID-19, OR OTHER COMMUNICABLE DISEASE OR ILLNESS, OR A BACTERIA, VIRUS OR OTHER PATHOGEN CAPABLE OF CAUSING A COMMUNICABLE DISEASE OR ILLNESS), LOST, STOLEN, DAMAGED OR CONFISCATED PROPERTY, AND ALL OTHER HAZARDS ARISING FROM, OR RELATED IN ANY WAY TO, ANY EVENT (INCLUDING COMPLYING WITH THE SAFETY REQUIREMENTS), WHETHER OCCURRING PRIOR TO, DURING OR AFTER AN EVENT, HOWEVER CAUSED AND WHETHER BY NEGLIGENCE OR OTHERWISE.

LinksDAO, Inc. is committed to providing a friendly, safe, supportive and harassment-free environment at the Events for all personnel, attendees and participants. The Code of Conduct set forth below outlines LinksDAO, Inc.’s expectations for all Event attendees and participants. Cooperation is expected from everyone and violations are taken seriously.

You and your belongings may be searched upon entry into any Event and while at the venue(s), and you hereby consent to such searches and waive any related claims. If you elect not to consent to any such search, you may be denied entry into or removed from the Event. No alcohol, drugs, weapons or glass containers may be brought to the Event.

At the Event, the safety and enjoyment of all personnel, attendees and guests are our priorities. The Events are private events and, as such, LinksDAO, Inc. reserves the right to remove any person from any Event. Any person who mistreats or harasses another person will be removed immediately and not allowed to return to the Event. LinksDAO, Inc. asks that you abide by common sense rules to guide your behavior. Please take a moment to familiarize yourself with (and when attending an Event please abide by) the following Code of Conduct:

ALL TICKET SALES ARE FINAL. NO REFUNDS OR EXCHANGES. IN NO EVENT SHALL LINKSDAO, INC. BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT OR EXEMPLARY DAMAGES OF ANY KIND, OR ANY DAMAGES BEYOND THE FACE VALUE OF THE TICKET, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF FACE VALUE FOR THIS TICKET.

YOU ALSO ACKNOWLEDGE AND AGREE THAT LINKSDAO, INC., IN ITS SOLE AND ABSOLUTE DISCRETION, RETAINS THE RIGHT TO CONDUCT (RAIN OR SHINE) OR NOT CONDUCT ANY EVENT, FOR ANY REASON, INCLUDING AS A RESULT OF INCLEMENT WEATHER, COVID-19 (INCLUDING ANY VARIANT) OR ANY OTHER FACT OR CIRCUMSTANCE. BY AGREEING TO THESE TERMS AND CONDITIONS, YOU HEREBY ACCEPT SUCH RISKS AND ACKNOWLEDGE AND AGREE THAT ANY FEES PAID BY YOU TO LINKSDAO TO ATTEND AND/OR PARTICIPATE IN ANY EVENT ARE NON-REFUNDABLE FOR ANY REASON.

The ticket is a revocable license. The holder of a ticket, on behalf of himself/herself and any minor(s) accompanying the holder (individually and collectively, “Holder”), agrees to all of the terms hereof. By using the ticket and entering the venue(s) or participating in the Event, Holder agrees to be bound by all of the terms of this license.
